Copyright is defined as an exclusive right of an author or a recipient of the right to publish or to reproduce a work or to give permission therefore without prejudice to restrictions pursuant to the prevailing laws and regulations. SCOPE OF COPYRIGHT The law on Copyright, enacted on 1997, protects works in the field of science, arts and literature. Notice that the copyright protection covers any work that is not or has not yet been published, but which has already been in an obvious form which would enable its reproduction. Protected works in the above mentioned fields include the following:
  1. books, computer programs, pamphlets, typographical arrangement of published works, and all other written works;
  2. sermons, lecturers, addresses, and other works of utterance;
  3. visual aid made for educational and scientific purpose;
  4. songs or music with or without lyrics, including arts of karawitan and phonograms;
  5. dramatic works, dances (choreographic works), puppet shows, pantomimes;
  6. performances;
  7. roadcasting works;
  8. all forms of art, such as paintings, drawings, engravings, calligraphy, carvings, sculptures, collage, applied arts in the form of handy-crafting;
  9. architecture;
  10. maps;
  11. batik arts;
  12. photography;
  13. cinematographic works; and
  14. translations, interpretations, adaptations, anthologies, and other works as a result of changing of form of mode (notice that these works are protected as a work of its own without prejudice to the copyright over the original work).
The law also stipulated not to grant copyright to:
  1. a work out of the field of science, arts and literature;
  2.  an imitate work;
  3. public work;
  4. any result of open meetings of the Highest State Institutions and High State Institutions and other constitutional institution;
  5. laws and regulations;
  6. court decisions and judicial orders;
  7. state addresses and government official speeches; and
  8. award of arbitration boards.
PERIOD OF PROTECTION Copyright protection for the following fields:
  1. books, pamphlets, typographical arrangement of published works, and all other written works;
  2. sermons, lecturers, addresses, and other works of utterance;
  3.  visual aid made for educational and scientific purpose;
  4. songs or music with or without lyrics, including arts of karawitan;
  5. dramatic works, dances (choreographic works), puppet shows, pantomimes;
  6.  all forms of art, such as paintings, drawings, engravings, calligraphy, carvings, sculptures, collage, applied arts in the form of handy-crafting;
  7. architecture;
  8.  maps;
  9. batik arts; and
  10. translations, interpretations, adaptations, anthologies, and other works as a result of changing of form of mode Are granted for: · the life of the author and 50 (fifty) years after his/her death if the work is owned by a single author; or · the life of the longest surviving author and 50 (fifty) years after the death of the said longest surviving author if the work if collectively owned by more than one person; or · 50 (fifty) years as from the first publication if the work is owned or held by a legal body.
 Copyright protection for the following fields:
  1.  computer programs;
  2.  phonograms;
  3. performances;
  4. broadcasting works; and
  5. cinematographic works are granted for 50 (fifty) years as from the first publication of the work. Copyright protection for photography works is granted 25 (twenty-five) years as from the first publication of the work.
GENERAL INFORMATION FOR REGISTRATION
  1. Copyright shall be granted on the basis of an application where each application can only be submitted for one work. The application shall be submitted in writing in the Indonesian language to the Director General of Intellectual Property Rights and is subjected to costs.
  2. The application shall contain: a. full name, citizenship and address of the applicant; b. full name, and address of proxy (a registered consultant on intellectual property rights) in the case of the application being submitted through a proxy; c. kind and title of the said work; d. date and place if the said work has been declared firstly; and e. two copies of said work description.
  3. The applicant must be signed by applicant or proxy of the applicant. Special power of attorney is required in case that an attorney submits the application. If an application is submitted by more than one persons and/or legal entity collectively that have right to the said work, all names of the applicants are mentioned by choosing one of the address as their address. The said application is signed by one of the applicants entitled to the mark by attaching the written approval of the representing applicants. An application for registration of a work conducted on behalf of more than one person and/or legal entity shall be permitted if the persons or legal entities are jointly entitled to or declared by a written agreement that they shall jointly be entitled to said work.
  4. Applicants domiciled outside of the territory of the Republic of Indonesia shall submit their applications through proxies. The applicants shall, therefore, state and choose their legal domiciles in Indonesia. Laws and Regulations Law No. 12/1997 concerning Amendment to Law No. 6/1982 concerning Copyright, as already amended by Law No. 7/1987.
